In the absence of a body of
time-tested appellate decisions, legislative history has proven to be a
key in TCPA litigation. Nearly every one of the pivotal TCPA decisions
has relied in part on legislative history.
While Westlaw provides full
text searching of legislative history, it does not have the text of some
critical documents. Notably missing is the hearing testimony on the
TCPA's precursor bills in 1989. This hearing testimony is over 120
pages long, and touches on many aspects of telemarketing that are not addressed
in later hearings or in the congressional record. Only on TCPALaw.com
has the text of this document been compiled into our comprehensive text
search engine, along with all the committee reports on the TCPA (and its
related bills that other searches miss) along with congressional record
text.
We have also obtained a number
of other critical documents cited in the legislative history, such as the
Field Research Report, and the text of the legislative history is linked
to these other documents where possible.
