What is the TCPA?


Consumers and businesses have the right to sue telemarketers and junk faxers who violate the law.  TCPALaw.com was started as a repository of documents, laws, court decisions, and research used by the consumers that helped them win these cases.   The Telephone Consumer Protection Act was passed in 1991 and restricts telemarketing and junk faxing.  It gives consumers the right to sue violators in their local court for $500 to $1,500 per violation. Class actions against violators are also available.
 

Consumer Suits

Since 1995, many consumers have gone to small claims courts against telemarketers and people sending junk faxes.  They decided to stand up and sue telemarketers and junk faxers and they won.  How many?  Well, hundreds.  Over $1 million dollars has been recovered by consumers in those individual lawsuits.... most in small claims courts.  Now the national do-not-call list violations will also subject telemarketers to suit too.   Not all actions are well founded.  Although not actual TCPA cases, we found the most recent decisions in the Ryan Swanberg series of cases on this site.
 

Class Actions

Then, of course, there are the big cases that really slap junk faxers where it hurts.  Nicholson v. Hooters - $12 million. Gans v. Seventeen Motors - settled for $6.5 million.  The Dallas Cowboys paid $1.45 million.... the list goes on.
 

FCC Enforcement

Federal Communications Commission FCC TCPA LinkThe FCC has also issued nearly 200 citations against telemarketers and junk faxers, assessing over $6 million in fines.  States have brought enforcement actions too.
 

The National Do-Not-Call List

The new national Do-Not-Call List is part of the TCPA, and you can also sue violators in your local courts for up to $1,500  per violations.  Same law and same resources.
